The limitations of liability set forth in this section shall apply regardless of the legal theory upon which the claim is based, including contract, tort (including negligence), strict liability, or any other legal or equitable theory, even if Round Table Pizza has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you.

12. Dispute Resolution

Except for claims for injunctive or other equitable relief, or claims relating to intellectual property rights, all disputes, claims, or controversies arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration administered by a recognized arbitration body in accordance with its then-current rules and procedures. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND ROUND TABLE PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Round Table Pizza agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.

12.4 Opt-Out Right

You have the right to opt out of the binding arbitration and class action waiver provisions of this Section 12 by sending a written notice of your decision to opt out to [email protected] within thirty (30) days of the date you first access our Services. Your opt-out notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
